Welcome to Come to Abba ("the App"), operated by Gerardo Herrera ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you are at least 18 years of age. We reserve the right to terminate accounts of users who are found to be under 18.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as needed. You must notify us immediately of any unauthorized use of your account.
You agree not to use the App to:
We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.
The App allows you to post content including group descriptions, event details, chat messages, prayer requests, and other materials ("User Content"). You retain ownership of your User Content, but by posting it you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content solely for the purpose of operating the App.
You are solely responsible for your User Content. We do not endorse, verify, or guarantee the accuracy of any User Content. We are not liable for any loss or damage resulting from User Content posted by you or any other user.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WE DO NOT GUARANTEE THE SAFETY OF IN-PERSON MEETINGS, EVENTS, CARPOOLS, OR ANY OTHER ACTIVITIES ARRANGED THROUGH THE APP. USERS PARTICIPATE IN ALL ACTIVITIES AT THEIR OWN RISK AND ARE SOLELY RESPONSIBLE FOR THEIR OWN SAFETY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Come to Abba, its operator, and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from your use of the App, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation by contacting us at adminworks@cometoabba.com. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association. The arbitration shall take place in the State of Texas. Each party shall bear its own costs.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
We may suspend or terminate your account at any time, for any reason, with or without notice. You may delete your account at any time through the App's profile settings. Upon termination, your right to use the App ceases immediately. Sections 4 through 8 of these Terms shall survive termination.
We reserve the right to modify or discontinue the App (or any part of it) at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
